PLEASE READ THESE TERMS AND CONDITIONS IN THEIR ENTIRETY. IF YOU DO NOT AGREE WITH THEM, PLEASE DO NOT PROCEED WITH UTILIZING THE SERVICES OF JEK TRAVELS LLC
We are JEK Travels LLC and we look forward to the opportunity to act as your booking agent for your travel needs. Access to and use of the services of JEK Travels LLC and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“Customer” and “passenger” and “you/your”) agree to be bound by these terms.
USE OF INFORMATION AND SERVICES:
Please thoroughly review these terms and conditions of JEK Travels LLC, and https://www.jektravelsllc.com. All reservation passengers will receive a copy of this booking receipt and terms and conditions. It is the sole responsibility of the lead passenger to inform all other parties traveling of the contents of these terms and conditions. The lead passenger, by accepting this receipt and making payment to JEK Travels and/or its suppliers, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions, liability waiver, assumption of risk and indemnification agreement and contract for all travel related services.
You warrant that you are at least 21 years of age and possess the legal authority to enter into this agreement and to make travel bookings with JEK Travels LLC by any means, including our Web site in accordance with all terms and conditions herein. You agree to be financially responsible for all your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of JEK Travels LLC communications by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with JEK Travels LLC is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities provided by JEK Travels LLC shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.
Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms and conditions of purchase imposed by JEK Travels LLC and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in JEK Travels LLC debiting your account for any costs JEK Travels LLC incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through access provided by JEK Travels LLC.
COVID-19 WAIVER
In 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Center for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC webpage at www.cdc.gov.
I understand and agree to the following:
1. COVID-19 is a highly contagious virus that can be spread via person to person contact;
2. After reasonable inquiry, JEK Travels LLC provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary.
3. Supplier(s) of JEK Travels LLC may have policies in place to help prevent the spread of COVID-19. JEK Travels LLC is not the drafter or holder of those policies and I understand that these policies can change at any time;
4. I understand that the supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate;
5. I understand that each state/country institutes their own pandemic- protective policies and regulations. I further understand that I am responsible for knowing, understanding and abiding by the pandemic- protective policies and procedures regarding COVID-19 of all state(s)/ country(ies) listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control;
6. I understand that by traveling, I can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s);
7. I am responsible for knowing, understanding and abiding by the pandemic- protective policies and procedures regarding COVID-19 of all vendors used in my travel itinerary, including any policy updates;
8. With full awareness and appreciation of the risks involved, I, for myself, and on behalf of my traveling companions, including, but not limited to, my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release JEK Travels LLC its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with JEK Travels LLC.
9. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of JEK Travels LLC services, or the services of travel JEK Travels LLC suppliers or vendors, specifically related to COVID-19.
PERSONAL TRAVEL CONCIERGE RETAINER FEES:
JEK Travels reserves the right to charge service fees for new reservation requests. These service fees ranges from $100-$450 per quote, depending on the details of the trip and the extent of research involved. The fee will be disclosed in advance and must be paid prior to the trip research commencing. The service fee is non-refundable and non-transferrable. You will have 30 days to book your trip with deposit after the quote is presented to you. After 30 days, the service fee is no longer valid and any new quote requests, will require payment of a new service fee. In the event of trip cancellation (whether you cancel it or it is canceled due to non-payment), the service fee will be retained by JEK Travels. JEK Travels retains the right to collect additional service fees if you request to makes changes or revisions to the original quote once the research has commenced. These changes/revisions include, but are not limited too: changes to the trip dates, changes to the destination(s), changes to the number of travelers, etc. JEK Travels will disclose the cost of the additional research fee prior to conducting the additional research.
PRICE QUOTES:
Price quotes for travel are not guaranteed until reservations are confirmed with full passenger names and deposit payment. All prices are subject to change without notice and are subject to availability. Unless otherwise noted, price quotes typically do not include airfare, baggage fees, gratuities, meals, telephone calls, resort fees, incidental items, souvenirs, airport transfers or travel insurance.
PRICES:
All prices listed are per person based upon shared twin room occupancy unless otherwise clearly specified. Prices do not include items of a personal nature such as laundry, wines, water, beverages, food (other than at all-inclusive resorts or where clearly specified), passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly. In case of human or computer error, JEK Travels LLC reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase, provided JEK Travels LLC receives a written cancellation within 10 days of price increase notification.
HONEYMOON & ANNIVERSARY TRAVELERS:
You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photo copy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your JEK Travel Vacation Planner if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.
REFUNDS:
All group hosted payments to JEK Travels LLC are non-refundable and non-transferable. This is because JEK Travels LLC has contractual agreements with hotels, airlines and other vendors that will not allow us to obtain any refunds. This way we can keep our package prices competitive and allow you to make monthly payments on your vacation.
PAYMENTS AND CANCELLATIONS:
Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption in accordance with each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for.
Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to JEK Travels LLC by utilizing the Trip Change / Cancellation Form on our website. As a result of cancellation JEK Travels LLC and third party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s websites. Cancellation penalties are advised at time of booking and provided to you upon confirmation.
If you have any questions, or any penalties are unclear, please contact your JEK Travels Vacation Planner. Cancellation fees will be charged to the credit card you authorized to pay for travel services. JEK Travels LLC cancellation fees are separate from vendor cancellation fees. Vendor policies regarding cancellation fees will be relayed to all clients in your trip quote documents. There is a minimum monthly payment for all trips that is noted in the quote and/or invoice agreement. If you cancel, your cancellation fee will be $150 per person in addition to the Vendor’s Cancellation Fee.
DEPOSITS:
Deposits are due at the time of reservation. All deposits are non-refundable and non-transferrable. All reservations (except where specified) will require a deposit and will be clearly noted the amount due and monthly payment plan.
CHANGE FEES:
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Due to Vendor(s) policy(ies) or time restraint(s), certain bookings may not be changed. All change requests must be sent to JEK Travels LLC by utilizing the Trip Change / Cancellation Form on our website.
Changes to an existing reservation, whatever the cause, will incur a $50 per person charge plus any additional supplier fees. This includes name changes and removal of any services such as optional tours and transfers. Please note that name changes to airline reservations are subject to full cancellation and rebooking.
Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services. will not be processed until the administrative charges have been received.
GROUP TRIPS:
JEK Travels reserves the right to change tour days or modify the itinerary as needed for JEK Travels group trips. If booking into a group trip you are still responsible for all payments on reservation if not cancelled in time before penalties are assessed. Reservations can be paid in full at time of booking as long as the trip still has available space.
PAYMENTS:
Payments by credit or debit card are preferred, and by authorizing charges to your card you expressly waive the right to chargebacks as a means to mediate disputes.
Please note that money orders are accepted for final payments (within 4 weeks of final payment date) and for initial deposits or group air only tickets. These must be made by credit or debit card only. If a credit card is declined, agent will attempt to contact client to remedy the situation. It is important to note that the package price may increase while the details are trying to be corrected in the matter of a credit card decline.
CLIENTS SHOULD NOTE THAT EVEN THOUGH THEY HAVE PAID FOR A VACATION PACKAGE OR SEGMENTS IN ADVANCE, HOTELS, AIRLINES, AND OTHER VENDORS WILL ASK FOR A CREDIT CARD TO BE USED DURING TRAVEL FOR INCIDENTAL CHARGES, BAGGAGES FEES, ETC. NEVER TRAVEL WITHOUT A CREDIT CARD WHICH CAN BE USED FOR THESE PURPOSES! IF YOU ARE USING A DEBIT CARD FOR DURING TRAVEL CHARGES, YOU SHOULD EXPECT THAT POSSIBLE HOLDS CAN BE PLACED ON YOUR ACCOUNT FOR SEVERAL DAYS AND THAT MIGHT AFFECT YOUR SPENDING CASH.
Always check with your bank to see if your card incurs foreign transaction fees if you plan to travel outside the US.
LATE FEES:
Final payments not received prior to the Final Payment due date will incur a late fee of $100 or 10% of the overdue balance, whichever is greater. All reservations are subject to cancellation and hotel penalties as described above, if final payment is not received on or before the due date. Late fees are always non-refundable. All cancelations must be received in writing.
RESERVATION REINSTATED:
If your reservations has been cancelled, and you notify us within 10 days that you want to reinstate your reservations, a service reinstatement fee of $100 ($250 for international trips) will be added to your invoice and must be paid in advance in order to apply for confirmation of reservation.
PASSPORTS AND VISAS:
Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided on travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest all passengers that are making reservations for a cruise to have a valid passport in their possession.
TRAVEL INSURANCE:
Missing a vacation is bad enough. Losing the money you paid for your vacation is even worse. Travel insurance is strongly recommended. JEK Travels LLC will send, via email, a quote for travel insurance within 72 hours of you making your reservation. It may be purchased, which may cover cancellation for covered reasons as outlined in the insurance policy. Insurance policies vary with differing exclusions (such as pre-existing conditions, work related issues, supplier bankruptcy, change of mind, etc.). While you are not obligated to purchase travel insurance it is highly recommend. Some International countries require the traveler to have travel insurance prior to traveling. JEK Travels LLC will not be responsible for you getting denied entry into a country for not fulfilling this requirement.
TRAVEL IDENTIFICATION:
Guests are required to make reservations in the full name that is listed on his/her government document they will use for travel. If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable. Photo identification is required for all travel. It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. JEK Travels LLC strongly recommends that you take into account that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/app/answers/detail/a_id/268/kw/travel for forms.
The U.S. Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Customer to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required.
ENTRY AND EXIT REQUIREMENTS:
Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (Details can be found at http://travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html.) JEK Travels LLC respects the privacy of all clients, and feel it is an invasion of privacy for any member of our staff to make such an inquiry.
TRAVELING WITH CHILDREN:
Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. This would apply to grandparents, only one parent traveling, or a divorced parent traveling. Travelers should confer with their attorney to get the correct paperwork in order, or you can find information here: https://www.dhs.gov/how-do-i/travel-overseas. Click here for our Parental Consent Form. JEK Travels LLC is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.
TRAVEL DOCUMENTS:
Once received by JEK Travels LLC travel documents are delivered electronically via e-docs. Documents will be sent (30) days prior to departure date. Physical documents will incur a $15 per person fee and will be shipped via US Postal Services, UPS or FedEx. For late bookings and re-booking, or if expedited delivery of documents is necessary, a $35 shipping fee will apply. We check all documents prior to delivery; please check your documents to confirm accuracy of all information. Call us immediately if any errors are found. Tickets and vouchers are negotiable instruments – keep them in a safe place at all times. Lost, stolen, or destroyed tickets/vouchers cannot be replaced or refunded
AIRLINE CONFIRMATION, CHECK-IN, SEAT ASSIGNMENTS, MISSED FLIGHTS:
JEK Travels LLC is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice.
JEK Travels LLC is not responsible for penalties incurred for tickets, international or domestic, not issued by JEK Travels LLC due to schedule and/or flight changes. Airline reservations completed online are subject to review and, should JEK Travels LLC deem it necessary, may be rebooked to match minimum connecting time requirements and/or tour package itineraries, in which case you will be notified immediately. Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked even when normal ticketing rules do not require tickets to be issued until a later date.
In this instance, JEK Travels LLC will require immediate and full payment of the airfare. This situation overrides invoice terms and conditions and payment due dates. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the same flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the passenger.
JEK Travels LLC will do its best to use major carriers for their flights. There may be times when discount carriers are used. Travelers will be notified beforehand if this is the case.
AIRLINE TICKET:
Once full payment is received, airline tickets will be issued and are fully non-refundable. Should airline tickets require issuance earlier than the final payment due date, client may be required to pay a larger non-refundable deposit and/or complete full payment.
It is important that you confirm your flights with the airline prior to departure: 24 hours in advance for domestic flights, and 72 hours in advance for international flights. Failure to confirm international flights or failure to use any portion of an airline reservation may result in automatic cancellation by the airline for all continuing and return flights.
Familiarize yourself with your airline’s policies and requirements before booking. Unless stated otherwise by the airlines, it is important to arrive at the airport at least 2 hours prior to departure for domestic flights and 3 hours prior to departure for international flights view travel documents for verification. Late arrival at the airport can result in loss of assigned seats or denial of boarding.
Denial of boarding is not eligible for refund or travel insurance reimbursement. Airfare rebooking is subject to airline penalties, rebooking fees, plus any cost difference of the new flight. Seat assignments are subject to change by the airline without notice.
SEATING ASSIGNMENT:
The airlines bears sole authority of assigning seats on group flights. JEK Travels LLC airline contracts are for economy class seats only. If you require another class of service, you may consider purchasing your own flights and purchasing your land only package from JEK Travels LLC.
AIRLINE NAME CHANGE:
Any name change including minor spelling corrections may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $50 or more revision fee per change. JEK Travels LLC will not be held responsible for the denial of services by a carrier due to any name discrepancy.
AIRLINE FUEL SURCHARGE:
If you purchased airfare, airline taxes and fuel surcharges are included. Prior to completion of full payment there is a potential for a price increase due to increases in government-levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are fully non-refundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes are indicated in our package presentation and pre-departure documentation.
HOTEL / RESORT ACCOMMODATIONS:
All rooms requested are standard twin-bedded (two single beds) rooms with private facilities, unless you have specifically requested a king/double size bed. Please understand although we will make a bed type request on your behalf, bed types are subject to availability. Room selection in all cases is strictly at the discretion of the hotel’s management on a run-of-house basis. Triple and quad occupancy rooms consist of two beds for cruises, where triple and quad rooms will consist a twin bed for each person. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. In the event you have a roommate and they cancel for any reason or plans change, you will be responsible for any additional charges that may come up as a result of moving to a single occupancy room. Although available at most 4 and 5 star hotels, use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are based on JEK Travels LLC agreements with its suppliers and are not negotiable. Hotel check-in time is generally not before 3:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late-night flight is being used. If a day room is included in the itinerary, check-out will normally be 6:00 p.m. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.
HOTEL/CRUISE DESCRIPTION:
JEK Travels LLC hotel and cruise ship profiles are based upon information provided to JEK Travels LLC by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. Star-ratings may differ from country to country. JEK Travels LLC does its best to maintain current information, however is not responsible for any inaccuracies, changes in description details or amenities, or images provided by third parties.
DINING:
As specified in each itinerary. Meals are based on the hotel’s or restaurant’s buffet or set menu. In general, beverages are not included, unless specifically stated. Although JEK Travels LLC cannot make guarantees, every effort will be made to honor special dietary requests submitted in writing at least 6 weeks prior to departure.
TRANSFERS:
Transfers are provided as indicated for each tour by car, minibus, or motor coach provided airfare is purchased from JEK Travels LLC. If you purchase a land-only tour, or if you deviate from the arrival and/or departure dates as stated in the itinerary, you will have the responsibility to purchase your own transfer to the hotel. Your arrival transfer is guaranteed for up to one hour from your scheduled arrival time in order to compensate for minor delays.
JEK Travels LLC or the transfer company will not be responsible for flight delays, for any reason, beyond one hour from your originally scheduled arrival time. In case of a delay, whether due to flight delay, immigration and customs, or time spent reporting baggage damage or loss, it will be your responsibility to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses will be your responsibility.
The cost of a transfer is more expensive than hiring a taxi, as a JEK Travels LLC transfer necessarily includes round trip service.
JEK Travels LLC transfer drivers, while not employees of JEK Travels LLC, are reliable. They provide you with a full welcome service, transfer you to the correct location and are prepared to answer your questions along your ride. Passengers comfortable hiring a taxi on their own and do not require assistance will save money.
EXCURSIONS:
Tours will be operated by motor-vehicle, its size dictated by the number of participants. JEK Travels LLC tours have been designed to accommodate individuals as well as groups. Times listed in itineraries are approximate and meant only as guidelines. Some itineraries may have early morning start times for sightseeing in order to complete the touring during daylight hours or avoid afternoon heat in tropical and desert climates. It is your responsibility to arrive on time for all scheduled flights, cruises, and package components. Arriving late may be considered a “no-show”, in which case you will not be eligible for refund for the unused service(s). We cannot guarantee the number of passengers who will be on any given tour. You may find that you are traveling with a sizeable group or only with your own companions. Services, however, will remain constant no matter the number of tour participants.
Persons requiring any assistance or who have any form of disability should travel with someone to assist them. On dates including, but not limited to religious holidays and national celebrations, some monuments and sites may be closed. On these occasions, touring itineraries may be amended to reflect these closures. Occasionally, during holidays and certain periods, and/or due to unforeseen circumstances including weather conditions there may be last-minute changes, sometimes after arrival, in affecting the sequence of the tour, locations visited and/or hotels. National monuments and tourist sites regularly undergo renovations, which can obscure the monument’s view.
No tour will be canceled due to renovations, however JEK Travels LLC will decide based on the conditions whether to amend an itinerary. JEK Travels LLC itineraries may contain suggestions for activities for your leisure time; these suggestions do not constitute an endorsement of any specific service provider and the decision to participate in any such activities should be made independently and with due consideration.
BAGGAGE FEES:
Due to continual changes in airline baggage policies it is suggested that you inquire with your airline’s website for up-to-date fees & information. JEK Travels LLC is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. We recommend that you use brightly colored luggage tags, straps or other identifiers to help you locate your luggage upon arrival or to describe it if it is lost.
DRESS CODE:
Please be advised that some resort restaurants may require Men to have long pants, collared shirt, & Closed-toe shoes. Please pack accordingly.
CRUISING:
Cruise itineraries and ships are subject to change without notice. Furthermore, cruise ships may be chartered and/or departure dates canceled, in which case all monies will be refunded. JEK Travels LLC takes no responsibility for ship substitutions or itinerary changes imposed by a cruise line and is not responsible for any losses you may incur including the issuance and/or cancellation of airline tickets or visa fees.
Many ships do not carry a doctor or nurse onboard. Should medical attention be required, local services will be contacted. Resulting charges will be the responsibility of the passenger. JEK Travels LLC and the cruise ship operator are not responsible for the services provided.
PHOTOGRAPHY / VIDEO RELEASE:
JEK Travels LLC may take photographs or video of its trips and the trip participants grant JEK Travels LLCpermission to do so for use for promotional or commercial use without payment of any compensation to participant.
HEALTH:
Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients’ health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs.
Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be removed from the group and directed to a local medical facility for diagnosis. Only upon clearance by an accredited medical facility will that individual be allowed to resume group travel.
All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will necessarily be borne by the passenger. Please note that some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. SAFETY RISKS:
Travel to certain destinations may pose a greater risk than others. JEK Travels LLC strongly urges that prior to booking international travel, customers familiarize themselves with current news events, travel prohibitions, warnings, announcements and advisories issued by the United States Government. By offering travel to particular international destinations, JEK Travels LLC does not warrant that travel to such destinations is advisable or without risk and shall not be held liable for any such damages or losses that could result from such travels. Clients booking constitutes acknowledgement and does so at their own risk.

ASSUMPTION OF RISK:
I am fully aware that travel such as that I am undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of JEK Travels LLC, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am aware that weather conditions may be severe, adverse and/or unpleasant. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of JEK Travels LLC and agree to hold harmless and release JEK Travels LLC from claims of third party negligence. I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition. I hereby authorize JEK Travels LLC or the local authorities or others to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent.
DISCLAIMER OF LIABILITY:
JEK Travels LLC and its employees, shareholders, officers, directors, successors, agents, and assigns, neither own nor operate any person or entity which is to, or does, provide goods or services for these trips or tours. For example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors.
JEK Travels LLC is not liable for any willful acts, errors, omissions, representations, warranties, breaches or negligence of any supplier, or personal injuries, death, property damage or other damages or expenses of other third parties resulting from causes outside of the control of JEK Travels LLC.
JEK Travels LLC is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of JEK Travels LLC. I release JEK Travels LLC from its own negligence and assume all risk thereof.
All services and accommodations are subject to the laws and regulations of the country in which they are provided. JEK Travels LLC is not responsible for any baggage or personal effects of any individual participating in the trips arranged by JEK Travels LLC. Individual travelers are responsible for purchasing a travel insurance policy, if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.

TRIP PARTICIPATION:
I acknowledge that I have voluntarily applied to participate on the trip designated on this application and that I have read the description of the trip as it appears in the current JEK Travels LLC website relating to the trip, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards involved.
PASSENGER AGREEMENT
By submitting a deposit or payment, you formally accept JEK Travel’s LLC Terms & Conditions as stated herein. Any violation will constitute a breach and forfeiture of any and all payments.
